Terms of Service

Createify is a technology platform operated by Gononet Technologies LLC, based in New York, United States. These Terms of Service govern your access to and use of the Createify platform, workspaces, APIs, and associated services. By accessing or using our platform, you agree to be bound by these Terms.

Createify acts as a software and marketplace technology platform connecting commercial brands and clients with independent creative professionals and creators. Createify provides the software infrastructure, brief tools, and escrow workflows, but does not provide content creation services as an employer or agency. All commercial creative agreements and deliverables are formed directly between clients and creators.

Users must provide accurate, current, and complete information during registration and onboarding. You are responsible for safeguarding your authentication credentials and for all activities that occur under your client or creator workspace. You must immediately notify Createify of any unauthorized use or security breach.

To protect creator payments and brand deliverables, all project communication, brief coordination, creative file submissions, and monetary transactions must occur exclusively through the Createify platform. Circumventing the platform, requesting off-platform payments, or soliciting users outside Createify is strictly prohibited and may result in immediate account termination.

When a client accepts a proposal or assigns a campaign brief to a creator, a binding commercial agreement is established between the parties. Creators agree to produce and deliver original assets matching the agreed creative specifications, format, and aspect ratio. Clients agree to provide complete product context, direction, and timely review feedback.

Payments on Createify are processed securely through certified third-party payment gateways, including Stripe. Campaign funds are held in secure escrow upon order placement and released to the creator upon client delivery approval or milestone completion.

Createify does not store or directly access full credit card numbers or sensitive banking credentials. By initiating transactions, users agree to the terms and privacy practices of the payment processor.

Creators must ensure that all delivered video and audio assets are 100% original, lawful, unencumbered by unauthorized third-party copyright, and recorded in accordance with professional quality standards and the campaign brief. Failure to adhere to standards may affect marketplace status.

Clients must provide clear brand guidelines, timely feedback, and constructive revision notes within the active review timeframe. Clients agree not to request deliverables outside the original agreed brief scope without additional compensation.

Upon full payment and escrow release, the client receives exclusive worldwide commercial usage and advertising rights to the final delivered creative master files, unless a custom license agreement is explicitly designated in the brief. Creators retain original ownership of unapproved drafts until full payment is finalized.

The Createify platform and all software services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. Createify does not warrant uninterrupted service or specific advertising performance metrics (such as ROAS, CTR, or view counts).

To the maximum extent permitted by applicable law, Gononet Technologies LLC and Createify shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from platform usage, user disputes, or commercial advertising results.

Createify reserves the right to restrict, suspend, or terminate accounts that violate these Terms, engage in fraud, breach off-platform transaction policies, or harm platform integrity.

These Terms of Service are governed by and construed in accordance with the laws of the State of New York and the United States, without regard to conflict of law principles.
